The State of the District.
A recurring bulletin for special district counsel and the consultants supporting their clients — what's happening, and why it matters for your districts.
Cyber threats facing Texas special districts.
Since late July 2026, water and wastewater utilities in at least seven states have reported coordinated attacks on internet-connected programmable logic controllers (PLCs) — the devices that operate pumps, valves, and treatment equipment.
Many MUDs and utility districts run the same class of PLCs, SCADA, and remote monitoring equipment, often installed by third-party vendors with limited district visibility into configuration or remote-access exposure. Incidents that start in operational technology can escalate into systems holding resident and customer records — triggering Texas breach-notification timelines.
